Justification of Lethal Force

Presenters - Green Ops Instructors Brett Harnish & Jay LaLuz

Generally, it is illegal to intentionally harm another human being. There are some specific circumstances when five mitigating factors can provide defensible reason to do so. Do you know what they are? If you carry a concealed firearm for self defense you absolutely need to! The factors that make it legally defensible to use force to stop another from causing serious bodily harm or death are: ability, opportunity, intent, imminent jeopardy and preclusion. Each of these factors will be covered in detail. Totality of the circumstance and the lens of objective reasonableness as well as Constitutional protections and considerations for selection of qualified legal counsel will also be presented. If you carry a firearm or any weapon for self defense you need to know this material to avoid taking action that can place your very freedom at risk. Become informed with the relevant knowledge of what is necessary and reasonable.

Jay LaLuz

Jay LaLuz was born into an Army family at the Army Hospital in Honolulu, Hawaii. Despite that, he enlisted in the Navy at the age of 17 where he spent his time trying to chase submarines and reading Tom Clancy novels. It was there that he was introduced to firearms and began to think that there might be something to that pursuit.

After his honorable discharge from the Navy, Jay worked in Information Technology with side hobbies in firearms and martial arts. During this time, he took numerous classes and pursued learning under several instructors. Along the way he gained certifications in teaching for both firearms and martial arts. He also competed on a local, state, and national level in shooting competitions. An economic downturn caused a change in careers, and Jay turned his hobbies of “shooting and getting punched in the face” into another career, namely law enforcement. Jay worked for the Metro Transit Police Department in DC for several years, not only in a patrol function, but also as a firearms instructor for that agency, doing recruit and in-service training, culminating in an assignment as range master to the police academy. Jay also gained certifications as a department armorer during this time.

Jay began teaching for Green Ops in 2016, assisting in pistol, rifle, and shotgun classes, as well as advising and developing lesson plans for those classes.

Today Jay works at the Northern Virginia Criminal Justice Academy as a Firearms and Control Tactics Specialist, where he oversees recruit training in both disciplines. He brings to the table over 15 years of firearms instruction as well as numerous certifications in various firearms disciplines, as well as related police tactics. Jay continues his firearms and control tactics pursuits by attending numerous classes each year. His belief is that an instructor must continue to be a student in order to remain relevant.
